			<content:encoded><![CDATA[<p>Long before the current financial crisis began, there were measures in place to allow homeowners to be forgiven for their debt. Generally, this meant going through a foreclosure or refinancing. Now, with millions of homeowners affected by theeconomic downturn, foreclosures, short sales and bankruptcy are rampant. This is where the <strong>Mortgage Debt Forgiveness</strong> Relief Act and Debt Cancellation come in.</p>
<p>Enacted in 2007, the <em>Mortgage Debt Forgiveness</em> Act means that people losing their homes are not required to pay any income tax whatsoever on the forgiven mortgage. This also covers debt taken on for home improvement. What it does not do is extend to second homes, vacation properties, or real estate investments.</p>
<p>The downside is that this tax-relief ends on December 31, 2012. Going through a foreclosure or short sale may very well take several months at least and many homeowners may find themselves facing the possibility of being responsible forthe taxes if their mortgage issues are not resolved in time.</p>
<p>Any homeowner planning to go through with a short sale should kick it in gear. As of the New Year the process will cost thousands of dollars more, potentially, than it does currently. Begin by talking to your bank about the short sale process. This is when the bank agrees to sell the home for less than what you, the homeowner, originally paid for the property. Any money you make from the short sale, as of next year, will be taxable income. On a $100,000 short sale, that could mean having to pay several thousand dollars, which may be impossible considering all that &#8220;income&#8221; is going directly to thebank to cover the debt.</p>
<p>Avoiding those taxes simply won`t be an option, as taxes are always lurking there, accumulating penalties and fees that only increase the size of what you owe. This doesn`t mean that it`s too late to begin the short sale process. In many cases, homeowners have been able to finish a short sale, from start to finish, in a couple of months.</p>
<p>Once your mortgage debt is forgiven, you will be required to fill out the Form 1099-C at the end of the year, which is a Cancellation of Debt form. There is a requirement to fill in the amount of debt that was forgiven contrasted with theproperty market value. This is required even with a foreclosure. In the event that you own investment property, or any other type of property debt that cannot be forgiven by law, bankruptcy may be the only option. Even this option comes with tax-relief provisions.</p>
